By accessing or using our website, purchasing our services, or participating in our retreats, classes, workshops, or any other events, you acknowledge and agree to abide by these Terms and Conditions. Additionally, you confirm that you are at least 18 years of age.

  1. Pricing

    Bodygardeners reserves the right to change pricing and service availability on the website at any time, without prior notice.

  2. Payment

    All payments for services must be made in full in GBP (£), unless otherwise stated. By agreeing to participate in a program, course, retreat, or other service, the Client commits to the total payment plan specified for that service. Selecting a payment plan means you are agreeing to pay the entire amount of your chosen plan, regardless of whether or not you fully participate in the program. The Client understands and accepts the following terms and conditions related to payment plans:

    a. Payment Responsibility: The Client agrees to make payments in accordance with the schedule outlined in the payment plan. Failure to pay on time may result in additional fees or penalties as specified in this agreement.

    b. Late Payments: If a payment is missed or delayed, the Client may incur late fees as determined by the Facilitator. The Facilitator also reserves the right to suspend access to the program until all overdue payments, including any applicable late fees, are paid in full.

    c. Default: If the Client fails to meet payment obligations as outlined in this agreement, it will be considered a default. In such cases, the Facilitator reserves the right to pursue legal action to recover any outstanding balance, which may include involving collection agencies or initiating legal proceedings.

    d. Modification of Payment Plan: Any requests to modify the payment plan must be submitted in writing and approved by the Facilitator. The Facilitator reserves the right to approve or deny any changes to the payment terms at their sole discretion.

    e. Non-Transferability: The payment plan is non-transferable and cannot be assigned to any third party without prior written consent from the Facilitator.

    f. Termination of Services: The Facilitator reserves the right to terminate access to the program or services in the event of a default or breach of this agreement, and no refunds will be issued for any payments already made.

  3. Cancellation & Refunds

    For day retreats, you will receive a full refund no less than 2 weeks cancellation notice prior to the retreat. If the notice is given less than 2 weeks you will not be refunded. For international or multi-day retreats, please refer to the specific terms and conditions provided. All deposits are non-refundable and will not be returned under any circumstances.

  4. Changes to Services

    We reserves the right to modify, cancel, or change any course, retreat, service, or this website at any time, for any reason, without prior notice or explanation.

  5. Promotions & Discounts

    Corporate discounts are available upon request.

    Promotions cannot be combined or applied retroactively.

  6. Retail

    Retail items purchased either in the studio or online can be exchanged within 30 days of purchase, provided they are unused and undamaged. If an item is found to be faulty or in unusable condition, a credit to your account at The Yoga Club Billericay or an exchange will be offered.

  7. Client Responsibilities

    By using our services, you take full responsibility for your own mental, physical, spiritual, and emotional well-being. You agree to inform us of any medical conditions, allergies, or food intolerances that may impact your participation. Additionally, you acknowledge that if you are experiencing suicidal thoughts, you will refrain from seeking services from Amy and will instead seek appropriate professional assistance.

  8. Medical Disclaimer

    We are not medical professionals and do not offer medical advice or guidance. The information provided on this website is for educational purposes only and should not be construed as a substitute for professional medical advice, diagnosis, or treatment. It is your responsibility to seek appropriate medical care for any health concerns you may have.

  9. Rights of Use

    9.1 By participating in our retreats, classes, workshops, or other events, you consent to the use of any photographs, videos, likenesses, or personal stories captured during these activities for promotional purposes, including but not limited to our website, social media, and marketing materials. It is your responsibility to speak to us directly if there are any images of you that you would like taken down or if you are not willing to be included in filming or photography.

    9.2 You grant us a non-exclusive, irrevocable, perpetual, royalty-free, worldwide license to use, including but not limited to publishing, exploiting, and altering, any material you email, post online, or submit to us. We reserve the right to use any ideas, concepts, content, text, or images in your communications for any purpose, to the fullest extent permitted by law.

  10. Intellectual Property

    All copyright, trademarks, and other intellectual property rights in the material or content provided on the Website remain at all times owned by us or our licensors, and are only permitted to use this material in accordance with the express authorisation granted by us. The material and content on the Website (including paid-for downloads) are provided for your personal, non-commercial use only. Any other use of the Website's material and content is strictly prohibited. You agree not to copy any of the material or content on the Website.

  11. Code of Conduct

    We expect everyone involved in our services to be kind, to refrain from using offensive language, to report any seemingly inappropriate behaviour, and to avoid spamming others involved. We do not tolerate any behaviour involving bullying, harm towards other clients, damaging property, or tarnishing the reputation of our business. We have the right to remove anyone behaving in this way from whichever offering they are partaking in without a refund.

  12. Confidentiality

    All information shared by our guides or fellow participants at any in-person or online services must be kept confidential. Anyone caught sharing this confidential information without consent will be removed/no longer have permission to our work.

  13. Liability

    Bodygardeners are not liable for any loss or damage to possessions of clients. Participation in any services provided on our website or in-person events are entirely at your own risk. We do not guarantee any specific results, and we are not responsible for any kind of outcome of either.

  14. Third-party Services/Websites

    We may provide you with access to third-party tools over which we have no control, monitoring, or input. We are also not liable for anything resulting from or relating to your use of optional third-party tools. Any use of these tools available on the site is entirely at your own risk and discretion. You should ensure that you are familiar with and agree to the terms and conditions under which these tools are provided by the relevant third-party provider(s).

  15. Insurance

    We ensure that anyone guiding or offering information is qualified to do so and insured.

  16. Law

    These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England. You irrevocably consent to the exclusive jurisdiction of the courts of England.
